These Terms of Service ("Terms") govern your access to and use of the Parker Sports Intelligence assessment and related websites, applications, and services (collectively, the "Service"), operated by Brain Games Hub ("we", "us", "our"). By purchasing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is a digital sports-intelligence assessment that presents situational items and produces scores across the Five Pillars of Sports IQ (Rules, Reads, Decisions, Math, and Language). The Service is delivered electronically; no physical goods are provided.
Access to a paid assessment is granted through an access code issued at purchase. Each access code may be used only as described at the time of purchase (for example, a single-use code authorizes one assessment). You are responsible for keeping your access code confidential; codes that are shared, resold, or distributed may be revoked. You must provide accurate information and be authorized to make any purchase you complete.
If the Service is purchased for or used by a minor, it must be done by, or with the verifiable consent of, a parent or legal guardian, who accepts these Terms on the minor's behalf. See our Privacy Policy for how we handle information relating to minors.
You agree not to: (a) copy, scrape, record, or redistribute assessment items, answer keys, scoring logic, or other content; (b) attempt to access the item bank or any non-public endpoint without authorization; (c) reverse engineer, probe, or disrupt the Service; (d) use automated means to access the Service except as expressly permitted; or (e) use the Service in violation of any law.
The Service, including the ParkerSI assessment, the Five Pillars of Sports IQ framework and scoring methodology, item content, animations, software, and branding, is the proprietary property of Brain Games Hub and is protected by intellectual-property laws. "Parker Sports Intelligence", "ParkerSI", and "Five Pillars of Sports IQ" are trademarks of Brain Games Hub. No rights are granted except the limited, non-transferable right to use the Service for its intended personal or institutional assessment purpose.
Payments are processed by Stripe. We do not collect or store full payment-card numbers. Prices and tier scope are as stated at the point of sale. You authorize the applicable charge when you complete checkout. Refunds and cancellations are governed by our Refund & Cancellation Policy.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Assessment results are informational and do not guarantee any athletic, academic, or professional outcome.
To the maximum extent permitted by law, Brain Games Hub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid for the Service in the twelve months preceding the claim.
We may suspend or terminate access for violation of these Terms, suspected fraud, or misuse of access codes. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
These Terms are governed by the laws of the United States and the state in which Brain Games Hub is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in that jurisdiction.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
